Role Overview The Export Compliance team is a global team located in all three geographies (AMERICAS, EMEA and APAC), and working with the Legal department. The team is responsible for defining processes and policies to ensure Husky’s compliance with dual-use and military Export Controls and Sanctions programs, and for monitoring their implementation throughout the company.
Your role will be to assist the Export Compliance team in implementing the Export Compliance program globally and enhancing its processes across global Husky sites. You will, amongst others, participate in raising awareness of the Export Compliance program among your collaborators, conduct legal reviews on Export Controls and Sanctions, conduct due diligence checks on transactions, ensure Support and Services teams deploy adequate measures to safeguard customer data, and determine the export control classification of the company’s software products.
Regulatory Compliance The Export Control Specialist plays a crucial role in ensuring that a company complies with all export regulations and policies globally. Some of the key responsibilities associated with this role:
- Monitoring Regulations: Keeps current on all international trade laws, regulations, and sanctions related to exports and specifically in the countries Husky exports from.
- Interpreting Rules: Interprets and applies export control laws to the company’s operations, ensuring compliance with export restrictions and licensing requirements.
- Dual-Use Controls- Liaise with Engineering and assist in establishing and implementing dual-use controls for all transactions globally.
Licensing And Documentation
- License Determination: Investigates and makes export licensing determination if/when licenses are required. This could potentially be multiple jurisdictions per transaction in the case of re-export.
- License Applications: Prepares and submits export license applications to relevant government agencies.
- Record Keeping: Maintains accurate records of export transactions, licenses, and authorizations.
- Documentation: Ensures proper documentation for shipments, including export declarations, shipping instructions, and compliance certificates.
- Audits: Reviews and audits export transactions to ensure proper export declarations are submitted to authorities and full compliance.
Risk Assessment And Classification
- Product Classification: Classifies products with support from Engineering teams according to export control lists (such as the U.S. Commerce Control List or Wassenaar Arrangement).
- Business Partner Screening: Understands and may support with Sanction Ownership and Denied Party screening escalations. Work with 3rd party vendors to ensure software and configurations are maintained.
- End Use Certificates/Statements: Develop and maintain a process for obtaining, validating EUC’s for all Husky business partners.
Training And Education
- Employee Training: Educates employees on export compliance, including awareness of restricted items and proper procedures.
- Internal Audits: Conduct internal audits to verify compliance and identify areas for improvement.
Collaboration And Communication
- Cross-Functional Collaboration: The manager works closely with legal, supply chain, engineering and sales teams to ensure alignment with export control requirements.
- Government Liaison: They communicate with government agencies, customs officials, and other relevant bodies.
Risk Mitigation And Due Diligence
- Risk Evaluation & Due Diligence: Performs regular due diligence and risk assessments per Husky business unit to ensure compliance, with all export laws associated with exporting specific products, technologies, or services to prevent unauthorized exports.
- Risk Mitigation Strategies: They implement risk mitigation strategies to prevent violations and penalties.
Required Experience & Education
- Five years+ export controls experience.
- Requires in-depth knowledge of various international laws and regulations governing the export and re-export of goods, weapons and technologies.
- Degree in an appropriate field of study, scientific or engineering background preferred.
- Experience of working in a multinational environment advising on international trade, sanctions and export control matters
- Strong experience with EU, US, CA export control regulations, in addition CN, CH, UK is a plus.
- Requires the ability to lead, motivate and manage to accomplish project objectives within timelines.
- Strong written and verbal communication skills; able to articulate and effectively communicate trade compliance information to various levels of non-technical audiences.
- Analytical skills with attention to detail and the ability to interpret complex regulations.
- Possess a high level of analysis, evaluation, and problem-solving skills as well as the ability to draw conclusions and decisions based on regulatory reasoning.
- Experience with influencing and supporting change management initiatives.
