What does this role look like?
The purpose of this role is to develop, implement, maintain, and evaluate the effectiveness of the Calgary Board of Education (CBE) Privacy Management Program, under the overall direction of the General Counsel.
This role provides a wide range of effective policy, program, and procedural recommendations to senior CBE officials, in addition to providing advice and assistance in interpreting legislation, ensuring the statutory appropriateness of decisions and compliance with legislation, and advising the organization on applying the privacy provisions to information management practices.
Major responsibilities include: provision of leadership, direction and operational support by interpreting and effecting compliance with legislative requirements of the Access to Information Act and the Protection of Privacy Act (the Acts); provision of guidance and recommendations to establish CBE policies regarding the Acts and to develop sound practices for the security of information; and provision of guidance to the CBE to ensure the protection of personal information according to the requirements of the Acts.
The sensitivity and potential nature of many of the subjects that this role deals with significantly affect the CBE’s reputation and the way the general public perceives the CBE’s policies. This role must defend and/or justify the CBE's recommendations in reviews or investigations conducted by the Office of the Information and Privacy Commissioner (OIPC). This role is also the CBE’s representative at inquiries held pursuant to the Acts.
The CBE understands the future of work is flexible. In this role, you are eligible to participate in a flexible work program that allows you to work remotely for up to three days a week. A minimum of two days must be in the office. At certain times, you maybe be required to work in the office more then 2 days per week based on operational requirements.
What will you do?
This role is accountable for developing, coordinating, and implementing effective guidelines and procedures to manage the CBE’s compliance with the Acts, for contributing to policies, and for providing support services on matters pertaining to the Acts. This role has overall accountability for implementation of the Acts and serves as the organization’s Privacy Officer under the Acts. This role is also accountable for establishing guidelines and for building organizational awareness and training in protecting private and personal information as well as for recommending the appropriateness of disclosure of routine and non-routine information. This role makes independent decisions on matters of project design, resources, and in assessing and reporting work performance for the program area.
- Provides strong leadership in developing and promoting information and privacy policies, guidelines, and procedures across all CBE programs.
- Develops the training, materials, and programs needed for Service Units and schools to become proficient in ATIP administration.
- Coordinates the delivery of ATIP training to CBE employees.
- Serves as the CBE’s key contact with officials from the OIPC to represent the CBE’s position in the administration of the obligations under the Acts, to participate in OIPC initiated reviews, inquiries, and breach investigations, and to ensure all requirements are met.
- Keeps the Board and senior management informed on legislative changes and issues, assesses options, makes recommendations, and develops strategies, procedures, and guidelines within the CBE to ensure that the legislation is implemented and complied with. Coordinates system awareness and disseminates information as required.
- Manages the expectations and requirements of the Acts, including finalizing and ensuring the effective and timely completion of access requests, coordinating the efforts of the CBE in complying with the Acts. Establishes a high degree of coordination of activities between the ATIP Coordinator, Superintendents, Principals, and CBE Legal Services.
- Provides expert advice on information disclosure and privacy protection practices to schools and Service Units.
- Assists schools and Service Units in establishing administrative standards, including technological and physical safeguards that ensure the confidentiality and security of records – especially records containing personal information – in the custody or control of the CBE.
- Develops and monitors procedures for administering the Acts within the CBE, including tracking requests; statistics reporting; and ensuring that legislative requirements are adhered to.
- Reviews provisions in legislation which affect the CBE and that may conflict with the Acts and works towards resolution to ensure that conflict is avoided.
- Coordinates and provides direction to ensure that reviews of CBE's agreements, procedures, forms, and protocols are in compliance with the Acts.
- Represents the CBE on matters relating to access to information and privacy legislation to the general public, private sector, and OIPC. Keeps the designated Head and General Counsel fully informed on matters that may require media attention.
- Liaises with officials from other school boards in Alberta, and other public bodies, as required, in implementing and administering the program to ensure requirements are met.
- Completes privacy protection impact assessments on programs/systems that deal with personal information.
- Serves as key member of the CBE Protection of Privacy/Access to Information Steering Committee and coordinates and plans the activities of sub-committees established to identify CBE issues relative to ATIP implementation.
- Performs other related responsibilities to achieve goals and objectives.
What are we looking for?
Required Education and Experience
- Bachelor’s degree in business administration, education, law, or a related field.
- Five to seven years progressively more responsible related experience delivering privacy management services for a complex public sector organization.
- Knowledge of the Access to Information Act and the Protection of Privacy Act is essential.
- CAPP Certification, Privacy & Access Council of Canada, or equivalent.
Preferred Education & Experience
- Information Access and Protection of Privacy Certificate, or equivalent.
- Knowledge of CBE policies.
- An equivalent combination of directly related post-secondary education and directly related experience may be considered.
Demonstrated Skills and Competencies
- Possession of strong interpersonal, communication, and analytical skills.
- Demonstrated tact and diplomacy skills.
- Excellent planning and project management skills.
- Ability to work within a team environment while under pressure to meet tight deadlines.
- Ability to work with minimal supervision.
