Mortimer Khoraych is seeking a full-time Investigations Associate with at least four years of workplace and/or institutional investigations experience to join our growing practice. Labour and employment law experience is considered an asset.

As an Investigations Associate, you will investigate workplace and institutional complaints involving allegations of discrimination, including micro-aggressions, Anti-Black/Anti-Indigenous racism, and unconscious bias, harassment, including sexual and human rights based harassment, retaliation/reprisal, workplace bullying, abuse of power/authority, conflict of interest and other misconduct.

You will engage with interesting, important, and at times complex and high-stakes files. You will work both autonomously and collaboratively with team members, while leading your own investigations.

Key Responsibilities:

  • Conduct Investigations in a fair, thorough and trauma-informed manner, including:
  • Conduct witness interviews;
  • Identify and summarize allegations;
  • Collect and assess relevant evidence; synthesize documents, data and other evidence collected;
  • Assess and weigh the evidence in order to make findings of fact and credibility;
  • Draft investigation reports;
  • Assess the findings of fact against statutory requirements and client policies;
  • Provide recommendations
  • Conduct Culture Assessments
  • Provide consulting services to clients regarding their internal investigations
  • Participate in Firm meetings, training and other initiatives
  • Engage in business development activities, such as article drafting or speaking engagements

Qualifications:

  • 4+ years of experience conducting workplace and institutional investigations. Labour/employment law experience is considered a requirement.
  • Demonstrable case-management, fact-finding, and analytical/evidence assessment skills in the context of conducting workplace investigations.
  • Strong grasp of rules of evidence and credibility assessments.
  • Ability to synthesize large quantities of information and identify relevant evidence and facts efficiently; excellent attention to detail, nuance and accuracy.
  • Excellent writing and report drafting skills.
  • Excellent interpersonal skills and written and verbal communication skills.
  • Strong client management skills and impeccably service oriented.
  • Excellent time and energy management skills, and ability to prioritize competing demands and deadlines in a fast-paced environment.
  • Professional, disciplined, motivated and a self-starter.
  • Ability to work independently in a remote work environment.
  • Ability to travel throughout Ontario and nationally at times.
  • A licensed member of the Law Society of Ontario in good standing.

We conduct workplace investigations into a wide variety of employment related matters. In doing so, we act as a neutral, arms-length party and provide unbiased conclusions and recommendations.

Our investigations are thorough, comprehensive and appropriate in the circumstances. We ensure that all investigations are conducted up to the standards required by arbitrators, administrative tribunals and courts, as applicable.

When we conduct investigations, we seek to maintain the confidentiality of all involved parties to the extent possible, and are cognizant of reputational risks that may arise. We complete investigations in a timely manner and aim to be as least disruptive to the workplace as possible.

Following the completion of the investigation, we issue a written report setting out our findings and conclusions. We also provide workplace remediation services and/or sensitivity or other training, as required.
