Position: Commercial Director

Department: Endless Surf (ES)

Location: Richmond, BC

Reports to: President, Endless Surf

Purpose:

The Commercial Director with Endless Surf is responsible for the full cycle contract process for the sale, construction and commissioning of Endless Surf products. This begins with the pre-contract phase and supports through the pre-and-post contract process in support of the processes from bidding through commissioning a pool. Special attention is required in regards of installation activities for large contracts both in terms of supporting business development and scope and specification for the work. The position partners across the organization and with external parties in addition to a good knowledge of the local contracting process and customs.

Key Responsibilities – What You’ll Be Up To

Documentation:

Owns the full Contracting process, including defines and maintains the Endless Surf contract templates, with the following collaborative processes are adhere to:

  • Ensuring all commercial terms, including risks and knowledge to the clients to the Chief Commercial Officer and Business Development team to execute on sales appropriately;
  • All agreed to terms with the ES Director, Operations to deliver ES products in line with contract to full customer satisfaction;
  • Working in collaboration with the Chief Technology Officer to ensure proprietary products are delivered consistent to product offering terms outlined in ES contracts;
  • Partnering with WhiteWater shared services teams, including:
  • Finance, to deliver expect margins levels;
  • Legal and Risk Management ensure compliance to company guidelines and liability policy.

Pre-Contract responsibilities:

Working collaboratively with the Commercial Team, participate in the bidding process through taking ownership of delivering the final step in the process, the commercial contractual agreement.

  • Guide the contracting process with potential customers to maximize the commercial position of Endless Surf
  • Supports clients and customers to understand the contractual terms and conditions, obligations and understanding of the products and services they will receive
  • Assemble and update contractual documentation in particular contract annexes related to specification, scope, schedule during the bidding and/or contracting process
  • Working in close collaboration with the Director Legal and Risk Management ensure that the company guidelines and objectives are followed during contract negotiations
  • Owns relationships and manages budgets with external legal parties in support of delivering the contractual process for ES, including but not limited to matters of intellectual property, liabilities, regionally specific matters
  • Liaises with the Operations team within ES for the final arbitrage
  • Other activities that might improve the overall process

Post-contract responsibilities:

Lead the commercial planning and execution across all Endless Surf Pool Construction Projects.

  • Signs off on commercial planning and execution across all Endless Surf Pool Construction Projects in compliance with Executed contract
  • Ensure compliance with legal standards and industry regulations
  • Support the schedule of values and improving the LC process
  • Collaborate with ES Operations and Site teams, including external third parties, to monitor progress and resolve issues promptly

  • Participate in meetings as might be required
  • Produce detailed financial reports to Senior Leaders and stakeholders
  • Other activities that might improve the overall process

Qualifications and Experience – Hard Skills You Bring:

  • Experience with all aspects of contracts, subcontracts, standard and non-standard terms and conditions
  • Minimum education: Bachelor’s Degree in Engineering, Business Administration, Law or relevant body of knowledge obtained experience
  • Minimum of 10 years of increasing experience in project delivery, construction, business, risk and contracting processes
  • Exceptional interpersonal skills with the ability to develop and maintain effective internal and external working relationships with all levels in the organization
  • Comfortable working in a fast-paced and dynamic environment
  • Energetic, self-starter with an entrepreneurial spirit
  • Must be legally eligible to work in the country of hire and have a visa secured in Canada
