Hybrid Job : This job offers the opportunity to work from home as part of a hybrid work arrangement. This arrangement will allow you to work some days at a TCHC work location and the rest of the time from home. The amount of time required to work at a TCHC work location is flexible, while considering operational and service delivery requirements.
Make a difference Reporting to the Senior Legal Counsel or their delegate, the Freedom of Information Specialist will respond to all Freedom of Information (FOI) requests, consult with other business units as required; assist in the development of training related to access to information and privacy requirements; and ensure that policies and procedures comply with access and privacy legislation. This position requires discretion in the handling of confidential and sensitive information and independent handling of complex and sensitive FOI requests and appeals
What You'll Do Processing and tracking of all Freedom of Information (FOI) Requests to fulfill 30-day deadline to ensure TCHC’s compliance with MFIPPA. Such steps include but are not limited to, the following:
- Answer all FOI inquiries from both internal and external stakeholders in a respectful and professional manner at all times via telephone calls and e-mails within 24 hours of receiving same.
- Clarify access requests with requesters as required;
- Identify voluminous requests and negotiate with requesters to reduce the size and complexity of a request;
- Transfer or forward requests to another institution if it is determined that another institution has custody or control of, or greater interest in, the requested records;
- Send third party notices to third party, whenever necessary (e.g. when requested records contain third party information);
- Search, locate, retrieve and review requested records. If necessary, coordinate and liaise with the respective units to search, locate and identify responsive records;
- Research, interpret and apply MFIPPA legislation, applicable Orders of the Information and Privacy Commissioner of Ontario, and/or case laws to decisions relating to access to information requests and identify applicable statutory exemptions;
- Solicit views from Senior Legal Counsel or delegate and other program units on the disclosure of responsive documents, if necessary
- Determine and sever exempt information and prepare photocopies of responsive records for disclosure
- Calculate estimate fees to be charged to requester
- Draft and revise decision letters on access requests
- Process and manage all stages of appeal process, including participating in mediations and drafting of representations during the inquiry stage
Reporting of all FOI request status to Senior Legal Counsel or delegate by submitting the following on a weekly basis:
- Entering information into systems used for tracking FOI requests and related files
- FOI deadline calendar
- Summary of all FOI routine requests
- Summary of FOI Requests of Note, i.e. requests that are of contentious in nature
Work in collaboration with Senior Legal Counsel or delegate and IT to:

Update the FOI manual of Policies and Procedures to provide a framework for compliance with MFIPPA

Compile FOI Statistical Reports by:
-
Preparing monthly and/or quarterly reports for submission to Governance, Communications and Human Resources Committee and to various other internal committees

Generating annual statistical reports for submission to Information and Privacy Commissioner when feasible
Record Management/Retention Of FOI Files By
- Maintaining a library on MFIPPA legislations and guidelines, and IPC orders for easy reference
- Maintaining the confidentiality of all current FOI files by organizing all current FOI files systematically in secured and locked filing cabinets
- Close and send old FOI files to Storage on an annual basis
What You’ll Need
- Completion of Post Secondary education. Ability to obtain RCMP clearance.
- 2 years of job related experience (work or co-op) in the management of FOI and privacy in a large public sector corporate environment.
- Coursework and training related to Access and Privacy legislation. Knowledge of MFIPPA and related legislation, regulations, policies, procedures, interpretations and Information and Privacy Commissioner’s orders pertaining to Ontario.
- Ability to research, interpret and apply applicable Orders of the Information and Privacy Commissioner of Ontario, legislation, and/or case law to decisions relating to access to information requests and identify applicable statutory exemptions
- Excellent customer service skills with an ability to exercise tact, courtesy and sound judgment in relations with internal and external interested parties.
- Works independently under minimal supervision, with occasional consultation for new or complex problems.
- Demonstrated ability to handle sensitive issues and maintain confidentiality.
- Ability to communicate effectively both orally and in writing.
- Strong project management, research and analytical skills.
- Demonstrated experience using software programs such as Microsoft Office.
- Oversee and direct work to administrative assistant
