Yamaha Motor Finance Canada (“YMFCA”) is the established captive finance division of Yamaha Motor Canada (“YMCA”), and a subsidiary of Yamaha Motor Finance Corporation (“YMFC”), which is focused on providing financial solutions to Yamaha dealers and customers through its Retail and Wholesale finance programs."

Summary of Responsibilities

Assist the YMFC (Yamaha Motor Finance Corporation) North America General Counsel in the development and ongoing management of the YMFC-CA (Yamaha Motor Finance Canada Ltd.) compliance management program.

Key Duties & Responsibilities

  • Primary duties include the operationalization of applicable legal/regulatory requirements through partnering with business units to achieve business objectives and regulatory compliance. Provide creative, practical, and effective approaches to strong compliance and governance.

  • Collaborate with various levels of management within the first line of defense to ensure controls are adequately designed to mitigate compliance risks.

  • Draft, review, revise, and approve policies, procedures, and guidelines in collaboration with the YMFC Legal Department to ensure business processes are in compliance with legal and regulatory requirements and enterprise-wide compliance programs.

  • Maintain a high level of awareness and knowledge of regulatory compliance requirements. Proactively identify and document compliance risks and help drive the mitigation and remediation of compliance issues. Communicate potential compliance issues to appropriate stakeholders and know when and how to escalate significant matters to senior management.

  • Oversee second line compliance transactional testing of first line businesses/operations. Ensure timely and accurate testing, reporting and escalation.

  • Advise the business on compliance risks related to new products, services or operations and advising and reviewing the design, development and implementation of controls to mitigate those compliance risks.

  • Oversee the preparation and conducting of regulatory examinations and audits; facilitate responses to findings, collaborate with the General Counsel, the YMFC Legal Department and applicable business units on appropriate remediation and corrective action. Provide necessary reporting to senior management and applicable governance committees.

  • Review and approve content and quality of training materials related to regulatory compliance requirements and issues. Ensure company-wide compliance of annual training requirements. Provide ad hoc training to first line businesses/operations, as appropriate.

  • Oversee Compliance second line review of the consumer complaint management function to ensure timely, accurate and thorough responses. Analyze consumer complaint data for trends that indicate potential compliance risks. Collaborate with the General Counsel, the YMFUS Legal Department and applicable business units on appropriate remediation and corrective action as necessary. Support the development of Compliance Department personnel by staying current of existing legal/regulatory requirements and being aware of industry trends and best practices. Enable coaching and professional education of direct reports where applicable.

Experience Requirements

  • Degree/Diploma: Bachelor’s Degree
  • Years of Experience: 5-7 years
  • Type of Experience: Regulatory agency or in a compliance, audit or risk management function at a Canadian financial institution or financial services provider.

Skills and Abilities

  • Experience, preferably with a regulatory agency or in a compliance, audit or risk management function at a Canadian financial institution or financial services provider.

  • Minimum 3-5 years of supervisory experience.

  • Experience should include advising on financial regulatory compliance issues with a strong knowledge of applicable federal, provincial and territorial consumer protection laws and regulations, including OSFI, FAFC FINTRAC, and PCMLTFA requirements; AML/KYC requirements, including the Proceeds of Crime (Money Laundering) and Terrorist Financing Act; debt collection laws; all privacy and anti-spam legislation (federal and provincial); and Quebec language laws.

  • Should also have an understanding of corporate compliance programs, including risk assessments, testing and monitoring, training, policy and procedure development and the process for implementing new products and business operations. Ability to communicate effectively both verbally and in writing with business professionals and attorneys.

Travel Requirements

Occasional international travel.

Expected salary range: $110,000 - $125,000/per annum

Although base salary for this position falls within the above posted range, final compensation will be determined based on the candidate’s skills, experience, qualifications, and internal equity.
