Grey County's Legal Services department is recruiting a permanent, full-time Provincial Offences Prosecutor. This job posting is for an existing vacancy.

Purpose
The Provincial Offences Prosecutor is responsible for representing the County in a range of lower court and tribunal matters. The primary responsibility of the Prosecutor is to act as a prosecutor for Grey County in respect of charges of violations of provincial legislation and Grey County by-laws pursued under the Ontario Provincial Offences Act and for charges of violations of federal legislation under the Contraventions Act.
The Prosecutor will advise the Solicitor on the effective conduct of such prosecutions, and assist the Solicitor in the development of policies, procedures, and systems for them. The Prosecutor will also assist the Solicitor in working with the Manager of the County’s Provincial Offences Court in establishing and maintaining procedures that make effective use of Court resources, and will work collaboratively and cooperatively with the Manager and the Provincial Offences Court administration team to implement those procedures and to ensure the smooth functioning of the County’s Provincial Offences Court as part of the County’s overall Provincial Offences team.
The Prosecutor will also represent the County, and will assist County departments and external legal counsel, from time to time in matters before the Small Claims Court and other courts and tribunals as permitted by their license. They will also undertake legal research assignments from time to time.
Responsibilities
Prosecution of Provincial Offences Act Charges
- Working collaboratively as part of the County’s Provincial Offences Court administration team, act as prosecutor under the Provincial Offences Act and the Contraventions Act for offences to be prosecuted by Grey County unless precluded by law or policy from so acting, and from time to time on behalf of Provincial Offences Prosecutor Legal Services other municipalities and agencies in respect of prosecution of offence charges that Grey County is prosecuting on their behalf
- Deliver service to the public and other participants in the Provincial Offences Court system, including defendants, counsel/representatives, and police and civilian witnesses in accordance with policies, standards, and practices established by the County, the Provincial Offences Court Manager, and the Solicitor with respect to delivery of service to the public
- Disclose to the Solicitor any actual or perceived conflict of interest that precludes the Prosecutor from acting in any particular prosecution as soon as the Prosecutor becomes aware of such conflict or the possibility of such conflict
- Review all charging documents for offences to be prosecuted by the County and screen all charges laid
- Request, obtain, review disclosure material from police/enforcement agencies or others pressing charges; disclose the same as appropriate to defendants requesting it
- Identify opportunities to resolve charges without trial in accordance with department policy; issue resolution proposal documentation where appropriate; meet/communicate with defendants and with defendants’ counsel/agents to discuss resolution of charges without trial; present proposed resolutions in Court
- Appear in Provincial Offences Court at first appearances, early resolution meetings, plea (resolution) hearings, trials, sentencing hearings, and other court appearances; examine and cross-examine witnesses, make submissions on law and on sentence
- Review appeals and interlocutory proceedings initiated by defendants; prepare documentation and submissions in respect of same and appear as required at appeal and other hearings and as permitted by your license
- Advise Solicitor on initiation of appeals and interlocutory proceedings by the County where recommendable; appear at hearings in respect of them as required and as permitted by your license
- Assist the Solicitor to liaise with Crown Attorneys, the Ministry of the Attorney
General, and the federal Director of Public Prosecutions in reporting matters required to be reported to any or all of them
- Communicate regularly with law enforcement agencies and civilian witnesses to determine availability of witnesses to attend at trials; work with Provincial Offences Court staff to schedule trial dates in accordance with witness & counsel/agent availability
- Provide training from time to time to local law enforcement agencies on prosecution of Provincial Offences Act charges
- Maintain statistics and summary information regarding the prosecution of Provincial Offences Act charges as required by the County
Assistance with Policy and Procedure Development
- Assist the Solicitor and relevant County staff in developing policies, procedures, and systems to effectively pursue prosecution of charges under the Provincial Offences Act and the Contraventions Act
- Together with the Solicitor, work collaboratively and cooperatively with the Provincial Offences Court Manager and court staff to assist in the development of policies, procedures, and systems to efficiently and effectively employ court and judicial resources in prosecution of charges under the Provincial Offences Act and the Contraventions Act
Advocacy before Other Courts and Tribunals
- Assist the Solicitor and County staff with matters before the Small Claims Court, the Landlord and Tenant Board, and other tribunals
- Appear from time to time before the Small Claims Court and such tribunals; review evidence, prepare witnesses, research legal argument, appear before court/tribunal and conduct trial/hearing
General/Other
- Maintain electronic files in respect of all matters assigned using County systems established for that purpose
- Perform legal research as required in support of court/tribunal matters, as well as in respect of County matters in general
- Maintain knowledge and skill at a high level with training and development through courses, workshops and selected reading.
- Perform other related duties that are assigned by the Solicitor from time to time.
Working Conditions
Hours of work are full-time weekly, including time beyond normal working hours if required by the Court.
Some work is conducted in open court before a judge or justice of the peace, opposing parties, their counsel or agent, court staff and members of the public.
Some work involves interactions (both in-person and remote) with members of the public who are charged under the Provincial Offences Act and parties engaged in disputes with the County. Such work may involve intense and emotionally loaded situations.
Regular travel throughout the year (generally once per week) will be required to attend at the Bruce County Provincial Offences Court location in Walkerton. Occasional travel may be required to other locations within and beyond Grey County.
Work involving appearances before courts and tribunals must be completed on timelines established by the relevant courts and tribunals, as well as in keeping with any agreement with, or any professional courtesy due to, an opposing party, their counsel or agent, and court and tribunal staff. Work conducted with the County’s Provincial Offences Court administration team must be carried about collaboratively and in a spirit of cooperation.
The position requires a valid Ontario driver’s license and clean police and security checks. The position requires that the incumbent to swear an oath or affirm before a judge or justice that they will act appropriately as a prosecutor, and that they govern themselves accordingly.
The Prosecutor must promptly disclose to the Solicitor any circumstance where they are charged with an offence under the Criminal Code of Canada or any other federal statute or regulation that is dealt with under the Criminal Code of Canada. They must also promptly disclose to the Solicitor any circumstance where they are charged with an offence under other federal statutes or regulations or under a provincial statute or regulation and where continuing to act in the position of Prosecutor may erode public confidence in the administration of justice.
Matters such as vacation scheduling, hours of work, attendance oversight will be handled between the Solicitor and the Provincial Offences Court Manager. Scheduling of vacation days may be restricted to avoid scheduled Court activity.
Contacts
Internal Working Relationships
Reports directly to the Solicitor and works alongside other Legal Services staff. Interacts routinely with Provincial Offences Court staff and manager and occasionally with staff from other departments. Must work collaboratively and cooperatively with all County staff as part of the County team.
External Working Relationships
Interacts with defendants and their counsel/agents in Provincial Offences Act and other court matters. Interacts with law enforcement agencies and their officers as well as municipal enforcement staff.
Knowledge and Skill
- If the incumbent is a Lawyer:
- A class L1 license to practice law issued by the Law Society of Ontario
- A law degree from an applicable Canadian law school (J.D. or LL.B.) (or
acceptable equivalent degree from a school in a foreign jurisdiction
together with a Certificate of Qualification issued by the National
Committee on Accreditation in respect of that degree)
- If the incumbent is a Paralegal:
- A class P1 license to provide legal services issued by the Law Society of
Ontario
- Satisfaction of the educational requirements of the Law Society of Ontario
for the issuance of such license
- Experience in advocacy, both written and oral, before courts and tribunals.
- Effective facilitation and interpersonal skills, particularly with respect to interactions with opposed parties.
- Personable, diligent and a client focused team player.
- Experience with procedures in Ontario Courts and Tribunals (as applicable to the incumbent’s license) and experience with and knowledge of:
- the specific legislation the incumbent would be handling matters arising under (e.g. the Highway Traffic Act, the Insurance Act, the Residential Tenancies Act),
- the use of municipal by-laws as regulatory laws,
- the legislation and rules governing the courts and tribunals the incumbent would be appearing before,
- the rules of evidence,
- directives issued by the Attorney General of Ontario applicable to municipal prosecutors acting under a transfer agreement made under Part X of the Provincial Offences Act (e.g. the Crown Prosecution Manual), and
- laws of general application applicable to municipal governments (e.g. the Charter of Rights and Freedoms, the Human Rights Code) and to prosecutors in general.
- Knowledge of law enforcement procedures and expertise in working with law
enforcement as witnesses in court proceedings.
- Working knowledge of electronic legal research systems. Able to work with standard office computer software systems, specialized electronic systems supporting court and prosecution functions.
- Understanding of the role of municipal government and its structures, both in general and as it relates to the prosecution of offences.
- Able to operate independently and exercise judgement as guided by law and County policy.
Restrictions
The individual employed as the Prosecutor:
- Cannot serve as a law or by-law enforcement officer in any capacity while employed as Prosecutor,
- Cannot hold elected municipal office while employed as Prosecutor, and
- Cannot have held elected municipal office in the 12 months preceding their employment as Prosecutor.
The Prosecutor must not do anything or place him or herself in any position where the integrity of the administration of justice could be compromised or appear to be compromised.
Impact of Error
Errors in representation of the County before courts and tribunals may result in judgments and determinations which are against the interests of Grey County and other municipalities which may be involved in delivery of provincial offences services, such as Bruce County. Errors in respect of Provincial Offences Act and Contraventions Act prosecutions have the potential to impact negatively on relationships between Grey County and other municipalities, law enforcement agencies, the judiciary, and the Ministry of the Attorney General and the Crown Attorneys; may also erode public confidence in the administration of justice.
Errors in assisting with the development of policies and procedures may result in additional work to correct those errors by those responsible for those procedures.
