We are looking for a Law Clerk, Trial Team
You will work in partnership with a dedicated team of litigation counsel, law clerks and litigation assistants to deliver effective and efficient legal services for cases across Canada. You will be involved in plaintiff and defence files related to a wide variety of issues affecting the organization, including fraud, complex claims, short term disability and long-term disability, investment-related matters and other issues. Applying your education, practice experience, and business knowledge, you will add value by providing key law clerk services and supporting all aspects of the litigation practice. You will help drive continuous process improvement and innovation within the litigation team.
What You Will Do
- Supporting Counsel in all aspects of case development
- Reviewing, summarizing, and analyzing initiating documents and file materials
- Managing production documents – monitoring incoming, pursuing outstanding requests
- Preparing for Examinations for Discoveries (Managing next steps, arranging dates, serving Notices, preparing electronic productions)
- Providing support to counsel at and following Examinations for Discoveries (document and exhibit management, note-taking, managing undertakings and refusals)
- Arranging independent medical examinations and preparing all related documentation
- Arranging surveillance and other investigations and preparing all related documentation, liaising with investigator and reporting to client and counsel
- Arranging mediations and preparing all related documentation, including draft mediation brief
- Drafting
- Preparing correspondence, pleadings, motion and application material, mediation briefs, surveillance instruction forms, medical briefs, settlement documents, closing documents (Releases, Orders, Discontinuances, Minutes of Settlement) and other materials on behalf of counsel
- Supporting Counsel in respect of Court appearances, including Trials and Motions
- Supporting all aspects of motions and applications, including drafting and assembling motion and application records, Factums, and Cost Outlines
- Supporting all aspects of pre-trial conferences, including preparing and assembling Pre-Trial Briefs
- Supporting all aspects of trial preparation, including managing trial-related deadlines, service of expert reports, Requests to Admit, joint document briefs, preparing summons to witness’, drafting Evidence Act Notices
- Practice and Document Management
- Reviewing and triaging incoming legal documentation
- Ensuring all relevant documents are properly stored in the Law Department’s Document Management Systems (M-Files) or E-Discovery platform (Relativity)
- Entering all relevant data in Law Department’s matter management system (eCounsel)
- Managing internal, statutory and court-imposed deadlines and limitation periods
- Taking initiative in determining next steps in respect of litigation files
- Other

What you will bring:
- Post-secondary diploma in a recognized law clerk program, or combination of education and experience
- Minimum 5 years’ experience as a civil litigation law clerk with a thorough understanding of the relevant rules of court and legal terminology
- Ability to work as part of a team and also to independently manage own workload, with well-developed organizational and time management skills, and to handle changing and competing priorities
- Superior communication skills, both written and verbal, including proofreading with keen attention to detail and the ability to draft substantive written communications and court materials (pleadings, briefs, and other correspondence)
- Strong technical skills (MS Word, Excel, Outlook, Adobe Pro, matter management and document management software)
- Excellent interpersonal skills
- Experience with Case Center (formerly CaseLines) and Justice Services Online filing portals is an asset
- Experience with Relativity an asset
- Experience working with highly sensitive and confidential information as part of daily duties
- Trial/Court Experience and experience working on complex litigation matters considered an asset
