SUMMARY – Accidents Investigator
Reports to: Accidents Manager
Shift: Monday to Friday 08:00-16:30
Reporting to the Accidents Manager, the Accident Investigator(AI) role is essentially an in house Insurance Adjuster. Because we are not an Insurance company we are not allowed to use the term Adjuster as it is has a formal designation.
The AI is responsible for opening and Managing the TransX Group Accident files. The goal is to manage each accident file to control and minimize the exposure of loss to the organization. Loss can come from litigation, subrogation from third parties or loss of use. The Accident Investigator will gather information from any available source to build a complete understanding of the accident details. Once all possible sources of information have been exhausted, the investigator will determine the preventability and establish a file reserve. This information is made available to the safety department so they may discipline, or train the involved drivers, if applicable. In the event there are third party injuries, our Insurance Carrier is put on notice of a potential claim.
The Accident Investigator will coordinate with accident scene attendees such as police, EMS, towing, recovery, and environmental contractors. Depending on the nature of the accident, the Investigator may hire an independent on-scene adjuster to attend the scene on TransX behalf. The AI will provide feedback and guidance to the on site adjuster to ensure they are acting in TransX best interest.
The AI will coordinate the recovery of TransX equipment and will work with the TransX claims personnel with regards to the protection of the freight. If the equipment is able to continue, the AI will ensure the equipment is inspected at the first possible location to ensure that any damage is documented and that it is safe to continue. The repair of damages will be coordinated by the AI. Estimates will be gathered from third parties and will be reviewed with the Accidents Manager. The AI has the authority to award work to vendors under $2,500 if there are multiple estimates. At the completion of repairs, the AI will arrange for inspection of the repairs to ensure they match the estimate and are up to TransX standards.
If the Accident liability falls with TransX, the AI will work with the Accident Manager to develop a strategy to minimize exposure. The AI, in consultation with the Accidents Manager will negotiate a settlement with the third party. The AI will prepare and present the third party with a legal release to protect TransX from future claims with regards to the Accident.
If TransX is not at fault, the AI will create a subrogation package for recovery from the third party or from their Insurance company. The AI will ensure all recoverable costs including soft costs like downtime or lost profit are included in the subrogation. The AI will negotiate a settlement with the third party.
If the accident involved a TransX Owner Operator, the AI will work to a satisfactory outcome for the OO while still ensuring all costs are justified. While it seems simple, this is often the most challenging components of the AI position.
If a file has not been settled, and reaches a point where the statute of limitations approaches, the AI and Accidents Manager will decide if litigation is required. Because of the complexity of the subrogations, the AI is responsible for their own collections.
KEY ACTIVITIES
Duties and Responsibilities include, but are not limited to:
- Gather all accident information and ensure the drivers are safe and sound, as well as the freight and equipment are secured, and TransX exposure is limited.
- Contact Police, First Responders and Towing and environmental to gather information so as to get a complete picture of what happened and determine liability.
- Hire and coordinate an on-site adjuster if needed.
- Open an electronic accident file and record the accident information that was captured.
- Document all correspondence and open an electronic file to preserve all evidence in case the file goes legal.
- Arrange with the tow vendors or the drivers for the recovery and relocation of equipment so it can be accessed for repairs or disposal.
- Contact vendors to get estimates for repair. Seek confirmation approval from the Accidents Manager for repairs over $5,000
- Track equipment and make sure the vendors are keeping to the timelines agreed to during the awarding of the work.
- Make sure the repaired equipment is inspected and is standard and if so, returned to service for use by operations. Alternatively write off the equipment and arrange for salvage.
- If the third party is fully or partially at fault for the accident, present them with an intent to claim, and when all costs are realized, prepare a subrogation file and distribute to the third party or their insurer.
- Negotiate with the third party until a reasonable settlement is achieved. Consult with the Accidents Manager about the file and the proposed settlement and agree on a settlement or a strategy.
- Get repair estimates for damages
- If the repair cost is close the vehicle value, use various resources to get a vehicle ACV
- Inform the Owner Op as to the disposition of the tractor.
SKILLS and KNOWLEDGE
Experience
- Grade 12 with post-secondary training in Business or Insurance Industry.
- While not required a CIP designation or completion of applicable courses is a benefit.
- Two plus years of dealing with multiple events and servicing multiple clients simultaneously. An understanding of Commercial transportation.
- Experience of working in a team environment and ability to work under pressure with tight deadlines. Organizational skills with good interpersonal and multitasking skills. Oral and written communication skills.
- Extensive experience and appreciation for negotiations and interpersonal skills.
- Strong multitasking and organizational skills, managing hundreds of active accident files.
- Excellent negotiation skills.
- Knowledge of heavy-duty equipment and the repair of it.
- Confident and collaborative, ability to work independently within a complex organizational environment with the ability to influence others without authority through knowledge, persuasion and cooperation
- Exceptional interpersonal, customer service, problem solving, verbal and written communication and conflict resolution skills
- Understanding of the insurance laws in each jurisdiction in Canada and the US.
