Job Title: Investigator (Conduct and Regulatory Standards) Job Family: Professional Department: Investigations Reports To: Supervisor, Investigations Division: Regulatory Location: Edmonton Competition: 26-37 Employment Indicator: Full-time, Permanent Position Summary Reporting to the Supervisor, Investigations the Investigator is responsible for investigating complaints of unskilled practice of the profession and/or unprofessional conduct against APEGA registrants and permit holders pursuant to the Engineering and Geoscience Professions (EGP) Act to determine whether sufficient evidence exists to refer an allegation to the Discipline Committee. The APEGA Investigative Committee (IC) comprised of volunteer professional members of APEGA, assigns 1-3 IC members to act as an Investigation Panel (panel) to oversee each complaint and investigation. The Investigator provides the support to guide the panel throughout the investigative process. Investigators possess the specialized background, knowledge and experience to suggest investigative strategies, coordinate and conduct interviews, and to gather credible and reliable evidence. The Investigator remains unbiased and objective to ensure procedural fairness for all parties. Upon collecting the evidence, the Investigator prepares a comprehensive summary of the investigation and drafts the preliminary investigation report which includes the Panel’s recommendation to the IC as to whether sufficient evidence of a contravention of the EGP Act exists. This role is well suited to candidates with experience conducting professional conduct, administrative, human resources, workplace, or complaints-based investigations, particularly in environments that support fair, evidence-based decision-making. The successful candidate will bring strong analytical writing skills, sound judgment, and the ability to communicate with parties in a fair, neutral, and service-oriented manner. Responsibilities Apply specialized training, experience, and expertise to develop effective investigation plans and strategies. Clarify and summarize complainant allegations into investigable matters (defined scope) which must be confirmed with the complainant to ensure accuracy. Determine who to interview (complainants, registrants, permit holders, witnesses, subject matter experts) and prepare for and lead the interviews with participation by the Panel as required. Conduct site visits when required. Communicate and collaborate with the panel to keep them informed of investigative steps and evidence gathered. Manage multiple cases which are prioritized based on the risk to the public. Gather and file documentary evidence. Work with a high degree of independence throughout the investigative process. In consultation with the panel, seek the advice or direction of third-party independent experts when investigating complex issues. Draft other formal documents as required (i.e., recommended orders/agreed statements of fact, interim suspensions, and updates to the IC). Provide evidence at formal Discipline Hearings. Prepare case files for disclosure upon appeal of allegations terminated for insufficient evidence. May recommend to the Supervisor, Investigations that a mediated resolution with the complainant and registrant may be appropriate. Identify the requirement for legal advice and seek approval from the Supervisor, Investigations prior to engaging legal counsel. Draft clear, well-organized investigation reports that synthesize evidence, identify relevant facts, analyze issues, and support the panel’s recommendation with well-reasoned rationale. The reports follow a standard, sequential format. The reports document and summarize the chronological facts supported by the documentary and witness evidence collected. Distinguish between factual summaries and analysis by explaining how the evidence does or does not support each allegation. Clearly articulate the panel’s analysis, reasons, and rationale for recommending referral to the Discipline Committee or terminating the investigation, ensuring the recommendation is supported by the evidence gathered. References to APEGA’s Guidelines and Standards are to be incorporated when applicable. Analyze and weigh the evidence against professional expectations, standard industry practice, ethical obligations, and applicable APEGA standards or guidelines. All reports are reviewed and approved by the Supervisor and Manager, Investigations, before being approved by the panel. Support Investigation Panels and the IC in their decision-making processes. Communicate strategies and updates to panel, execute panel instructions, meet with panels as required Attend IC meetings as an expert resource to support the presentation of the panel’s report and recommendation. Competencies, Skills & Attributes Competencies Knowledge, Skills & Abilities Core: Exemplifying Integrity Fostering Communication Results Orientation Service Excellence Teamwork Functional: Analytical Thinking Applied Investigation Attention to Detail Initiative Planning & Organizing The Engineering and Geosciences Professions Act, Regulations, Bylaws and Practice Standards and Guidelines Ability to utilize investigative and interviewing techniques and follow the investigation process to gather evidence and document evidence and data Investigative techniques and case management Interviewing techniques Administrative law, professional regulation, and investigations that support fair, evidence-based decision-making by boards, committees, panels, tribunals, or other similar bodies APEGA Registration processes and statutory obligations, including an understanding of a wide variety of compliance and disciplinary issues within the profession Governance for boards and committees Knowledge of expert resources and how to access them Ability to interpret the EGP Act, case law and the ability to apply this to specific cases/situations Ability to synthesize large and/or complex evidence or data into rational and logical recommendations/decisions Superior communicator both verbally and in writing (i.e., ability to draft investigation reports and articulate reasons based on the evidence) Conflict mediation, resolution, and decision-making abilities Ability to provide evidence at Discipline Hearings Ability to lead and influence others through process knowledge expertise Ability to empathize with broad/diverse groups of stakeholders Qualifications Related post-secondary education or equivalent training and experience in professional regulation, conduct, human resources, or workplace investigations, administrative law, public administration, complaint resolution, ethics, governance, or a related field is required. 3–5 years of experience conducting investigations, reviews, complaint assessments, or fact-finding processes in a regulatory, workplace, professional conduct, administrative, or public interest environment, including work that supports administrative or professional regulatory decision-making by a regulator, tribunal, board, committee, workplace investigation function, professional conduct office, or public interest body, is required. The demonstrated ability to write organized, concise, and well-reasoned investigation reports is required. Experience working within a professional regulatory body, tribunal, board, committee, or similar oversight environment, including applying legislation, standards, policies, or codes of conduct to support fair and evidence-based decisions, is preferred. An engineering and geoscience degree or professional designation with APEGA is an asset. The demonstrated ability to conduct complex investigations or reviews and draw conclusions or make recommendations is an asset. Equivalencies may be considered.
